According to this law, the activity of renting real estate for a duration of no more than 30 days, by whomever exercised, is presumed to be entrepreneurial within the meaning of Article 2082 of the Italian Civil Code if the number of flats to be rented out exceeds four units.

Implications of the Law

In practice, this means that if during the year the ‘fifth‘ flat is used for short-term letting, the activity is considered entrepreneurial from the beginning of the reporting period. This can lead to several critical issues, both from a tax and an accounting point of view:

1.         For income purposes: it will be necessary to reconstruct the accounts and document all the expenses incurred, which can be complex and burdensome.

2.         For VAT purposes: it will be necessary to take into account the fees received before opening the VAT number, with all the complications that this entails.

 

Short-term lettings represent an extraordinary opportunity for both tourists and property owners in the Oltrepò Pavese area. However, it is essential to be aware of the regulations in force and the tax implications in order to manage this activity efficiently and in compliance with the law.
